Our T&C's
Payment - to secure our service we have the following payment terms:
Web & Design clients - 50% deposit to secure services and remaining 50% to be paid once site is complete.
App clients - payment in full at the time of confirmation.
Marketing clients - monthly retainer paid in advance (minimum terms may apply).
Deposits are non-refundable and non-transferable.
Customers on monthly payments are required to set up a direct debit.
Please note when payment is overdue, we may suspend work, service and or delivery until payments have been made.
We aim to deliver an open and responsive service during working hours, 8am to 6pm Monday to Thursday and 8am to 5pm Friday.
Please refrain from private messaging any Think Zap team member on Slack. Use your dedicated support channel for all communication instead. Private messages will be ignored.
If a project takes longer than 6 months to commence (due to client delays, lack of communication or another reason beyond Think Zap’s control) an extra payment may be required to restart the project.
Generally for our web design agreement it is a 3 stage approval process; one full set of amends, second review of amends and final approval and small ‘tweaks’. After a design has been signed off by any design changes thereafter may be subject to additional charges.
Project timelines will be provided as a guide only. Hard deadlines will be communicated to you and confirmed once the previous deadline has been met. This includes launch dates.
Once the website has been built you will be given the opportunity to review the website and create a “snagging list” ahead of launch. Think Zap deems a “snag” as a small amend (for example, adjusting the spacing between an image and a body of text). Design changes are not considered “snags” and may be subject to additional charges.
Site Completion: Think Zap deems a website to be complete when it fulfils the original design brief. This does not include third-party sections, consisting of (but not limited to); newsletter signups, review sections, payment gateway integration or any content that can’t be managed by the user.
Our recommendation is that we go live with new sites on Tuesdays, Wednesdays and Thursdays. A Friday website launch is not possible.
Delay of a website launch due to the clients personal preference will not delay when balance payments are due.
As part this web project you agree to Think Zap hosting your website for a minimum of 12 months and as such you agree to pay the monthly hosting costs.
Major changes or additional features to your project/website site should be communicated accordingly as a separate brief and are not included in our support packages. Requested changes will be assessed on a case by case basis and there may be additional charges. To avoid disappointment, we recommend submitting requests at least 4-8 weeks in advance.
We require a sign up to our monthly support package at a minimum of £350 +VAT per month (or 20% of server costs, whatever is greatest). The support package includes a Zap license fee, regular updates & security patches and any new plug-in products of features as they become available. Monthly support is for an initial 12 month commitment. Thereafter a 3 month notice is required to cancel.
Out of hours/weekend/bank holiday cover is available, for monthly support clients, until 9pm and only when it is an emergency/business critical. This is at a charge of £89 per hour and £249 call-out fee.
For Marketing our services are for a minimum period of 3 months. Thereafter the notice period to cancel agreements is 1 month, with this rising to 3 months after a year.
We require full admin access to all relevant social media accounts for any of our marketing services.
For Apps there is a minimum annual maintenance fee of £349+VAT to cover works associated with updates inline with iOS and Android. Other premium maintenance packages are available.
Please note Think Zap Ltd retain the Intellectual Property rights to all development and bespoke tools used in providing services covered under this agreement and as such these should not be replicated and/or transferred under any circumstances.
As we endeavour to constantly improve our service we reserve the right to revise, alter, modify or amend these terms and conditions.
